Welcome to Furniture Express’s website. The following Terms and Conditions apply only to order placed via the Furniture Express’s website or via mobile orders on 0945-583-9606

JABS Furniture Marketing “furniturexpress.ph” reserves the right to change these terms and conditions at any time without prior notice to you and any changes will take effect on the day they are posted. Your continued use of the website constitutes your agreement to be bound by the prevailing terms and conditions. You will be required to read and accept these terms and conditions every time you place an order. For this reason, we encourage you to review them whenever you use this website to ensure that you are familiar with the latest terms and conditions. You must be of legal age of 18 to access this site. If you are under 18 and placed an order via this website the Parents or Legal Guardian shall be bound to our Terms and Conditions and held liable to any purchased made.

The following Terms apply to any Order that you place through our Website. You are required to accept these Terms to purchase any product or service we offered. If by any means you will not accept these Terms, you will not be able to order any product through our Website. Please read the Terms carefully before purchasing as by making a payment online you will be agreeing to and accepting these Terms.

Conditions of use

  1. To place an Order, you must be over the age of 18.

Accuracy of personal information

  1. You agree that you have provided accurate and updated basic information about yourself. We need this information to provide you the best service we can.
  2. To prevent any unauthorized person from using your account while using our website, you are responsible for any confidentiality of your account and password.
  3. You are responsible for all activities that occur under your account. If you notice any irregularities in your account, please tell us immediately.
  4. If you didn’t notify us of any incident regarding your account. You will be held accountable to settle any product or service rendered. We will not refund/return any product due to it is your responsibility to inform us. Please refer to sentence C.

Your obligation

  1. When you have placed your order by clicking on “Pay” within Checkout, you will be under an obligation to pay for the Products.

Our contract

  1. If we accept your Order, these Terms will form the basis of the Contract between us. Please see section 2 below that tells you more about the Contract between us. We suggest to keep a copy of your Order Confirmation Email.

Accuracy of order information

  1. It is your responsibility to ensure that you input and submit your Order correctly and accurately, including providing any and all additional information pertaining to your Order. You will have the opportunity to correct errors before placing the Order and an Order Summary (with details of the Goods and the total price inclusive of all delivery charges and other costs will be displayed directly before you pay for your Order, at which point your order will be considered placed. Please note that we are not responsible for any errors you make when you input and submit, and effectively place your Order.)
  2. Make sure that all information with regards to your order are accurate and correct. You can double check or change your order before placing it

Creating the contract

  • Acceptance of order
    1. After you have submitted your Order we will send you an order acknowledgement email shortly. Please note that this email is an acknowledgement and not acceptance of your order. You should note that:
      1. We are not obliged to accept your Order and no contract exists between us for those Products at this stage.
    2. We will decline your order if the products are not in stock or are no longer available. We will contact you with additional information and will not process your order.
    3. The creation of the contract between you and us will take place upon the successful delivery of your order unless we have notified you that we do not accept your order as outlined in B.
    4. It is recommended that you keep in mind all emails relating to your order.
    5. If you want to make any changes to your order, contact us by email, live chat box, or call us 0917-591-7046 for further assistance. Changing an order may cause a delay with your delivery time and may alter the price you have been quoted.

 

  • Non-Acceptance of Order
    1. We reserve the right not to accept any Order request if:
        • We have insufficient stock.
        • We do not deliver to your area.
        • The Products ordered was incorrectly priced.
        • The Products are withdrawn by the manufacturer.
        • The payment transaction is not authorized.
  • Stock levels
    1. As much as possible all items featured are either in stock and available at the time of ordering, or are produced to order with the estimated lead-time available on site.
  • Unforeseen circumstances
    1. While every effort is made to meet our customers’ demands, cancellations or discrepancies may be necessary as a result of an act of labor dispute, fire, flood, or other causes beyond our reasonable control.

Products and Services

    1. Images of Products displayed on our Website are for illustrative purposes only. They may not represent the actual size of the Products. Also, we cannot guarantee that the way your computer displays colors will accurately reflect the colors of the Products.
    2. The quantity, quality, description and any specifications of the Products will be described in the Order Confirmation Email.
    3. Once in a while we make special online discounts and promotional offers. These discounts and offers is subjected to their own specific terms and conditions stated on the Website as well as these Terms.
  • Payment
    1. Prices on our Website is in Philippine peso. We will ensure that the prices stated on the Website are accurate and up to date. If there are any errors, you will be notified by email or telephone and we will give you the opportunity to re-confirm your Order at the correct price.
    2. Your chosen payment type (Debit card, Credit Card, PayPal, Cash On Delivery, and etc.) will be charged when you submit your order at the final stage of the checkout whether you are paying in full or have only chosen to pay a deposit of 30%. (Cash on Delivery Only)
    3. Depending on how you choose to pay, your payment may be subject to validation checks and/or third-party authorizations.Your order must be paid in full prior to delivery. It is not possible for the delivery staff to take payments unless Cash on Delivery is chosen for the mode of payment.
    4. Prices is excluded of delivery charges and other fees.
  • Security and Clearing
    1. All credit and debit card payments that are made on our website are protected by a secure connection. This secure connection ensures that your credit and debit card is encrypted prior to transfer to the bank for authorization.
    2. As an additional security measure, no credit or debit card details submitted online are stored directly by us once your order has been processed. They are stored in encrypted form by our payment providers, BDO Unibank, Inc. and Paynamics.
    3. If you have authorized us to obtain a second or final payment of your order on your chosen credit card, we will use the same secure connection to request these charges to be transferred to the bank for authorization. Your CV2 number is not retained by our Secure Payment Provider.

Delivery and Receiving

  1. We aim to deliver your furniture within the time quoted on our website when you place your order. These are quoted as the estimated length of time that we believe we can deliver the order to you based on stock availability and/or delivery times provided to us from our suppliers and are supplied in good condition and may be affected by an Event Outside Our Control. Where multiple items have been ordered, we will endeavor to deliver them all together before the longest delivery time quoted, unless a split delivery is specifically requested. A requested split delivery will be subject to a further delivery charge. If the circumstances of your order change, we will contact you.
  2. Once your complete order has been received, we will endeavor to deliver your order to you as swiftly as possible and usually not later than 3 days after it becomes available.
  3. You will become the owner of the goods at the time of delivery provided we have received payment in full.
  4. Our Delivery Service team will carefully install your new furniture in your home, exactly where you want it (subject to access). Please make sure that the areas you want the furniture placed is cleared. They will then remove all wrappings and packaging and dispose of them for you.
  5. To make sure you are completely satisfied with your furniture, the delivery team will ask you to sign the delivery receipt after the furniture has been installed.
  6. All deliveries will be pre-booked and must be signed for. If you are out when our delivery team arrives, we will message and email you to give us a call to arrange a new delivery date. Please note that there may be an additional charge for failed delivery where the failure to deliver is no fault of ours, or where less than 24 hours’ notice is given for a customer cancellation.

Accuracy of placement information

  1. Before placing an order, please check and ensure access to all necessary areas of the destination room including width and height of doors, halls, stairs, landings or access gates and passages.
  2. If the order cannot be safely delivered or if no-one is available to accept delivery on the day agreed, you agree to ensure access and a re-delivery charge depending on your location.

Pre-order Cancellation

  1. If you wish to cancel your online order at any time prior to delivery with no charges, all you need to do is advise us either by call, text, email, or thru our Facebook Page. Our contact details can be found at the bottom of the page
  2. Once we’ve confirmed that we’ve received your cancellation pre delivery, you’ll receive a full refund to the original payment method used to pay for the order.
  3. Refunds made to a credit or debit card or via PayPal may not show in your account straightaway due to the clearing time required by banks to process the refund. Please contact your card issuer or bank directly with any queries

On the day Cancellation

  1. Once cancellation was made upon delivery, the customer is subjected to 30% restocking fee from the total amount purchased excluded of delivery charge.
  2. We do not cancel thru credit or debit card or via PayPal, all refunds will only be processed thru online bank transfer.

Damaged or Defective Products

  1. Every effort will be made to ensure that the goods you have ordered arrive undamaged and without defect.
  2. However, if the goods are found to be either damaged or defective in any way at the time of delivery, you have the right to the following options:
    • Reject the goods
      1. You will be asked to complete an Incident Report form immediately, which you have to fill out on our website.
      2. It will be logged to your order number and a refund will be given (including any delivery charges and other fees) in any event within 30 days of cancellation being accepted.
    • Keep the goods
      1. If the furniture is useable, despite the damage, we are happy for you to go ahead and use it.
      2. The delivery team will send us an incident report, then it will be logged to your order number, and assessed for necessary further action.
      3. We will then contact you to arrange a technician to visit and repair the problem to manufacturing standards within 7 days.
      4. If it’s unrepairable, we will replace the furniture or give a refund included of any charges. The products must be in our possession before the refund is given.
    • If the damage is discovered after delivery;
      1. You should complete an Incident form as soon as possible or at the latest within 7 days of receiving the products on our website.
      2. We will contact you to arrange a technician to visit and repair the problem. If the technician is unable to resolve the problem, we will discuss your options including returning or repairing the product to manufacturing standards, generally within 14 days.
      3. In the event that a repair cannot be made, we will replace the furniture.
    • Problems that develop after 30 days of Delivery: In the unlikely event that one of our items is to develop any damages after 30 days, please contact us via call, text, email, or thru our Facebook Page. Your options may vary depending on the individual circumstances including the length of time that you have had the item and the nature of the fault.

Furniture Express is providing this Website on an “as is” basis and makes no representations or warranties of any kind, whether express or implied, in relation to this Website or its contents and disclaims all such representations and warranties. In addition, Furniture Express makes no representations or warranties about the accuracy, completeness, or suitability for any purpose of the information on this Website. The information contained in this Website may contain technical inaccuracies or typographical errors. All liability of Furniture Express howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.
  2. Neither Furniture Express nor its owner, employees or other representatives will be liable for loss or damage arising out of or in connection with the use of this Website. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
  3. Furniture Express accepts no liability for any information or content contained in external third-party websites which link to or from this Website.
  4. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Website or any content on it, whether express or implied.
  5. Our website is for private use only. You agree not to use it for any commercial or business purposes, and acknowledge that Furniture Express is not responsible for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  6. We are not liable for any loss or damage caused by a virus or other harmful material that may infect your computer as a result of your use of the Website or your downloading of any content on the Website, or on any linked website.
  1. Our Website is available and may be accessed on a temporary basis. We reserve the right to change any part or all of the Website without notice. We make no guarantee that the Website and its content will always be available without interruption. We will not be liable to you if, our Website is unavailable at any time. You are responsible for arranging access to the Website and ensuring that anyone accessing the website via your internet connection are aware of and comply with these Terms and Conditions.
